BYLAW NO. 3670

A bylaw to regulate the use of 108 Greenbelt
Community Use Property.


WHEREAS the Board of the Cariboo Regional District, hereinafter called the “Board” has acquired the dedicated land within Electoral Area “G” known as the 108 Greenbelt; and,

WHEREAS the Board deems it necessary to make rules and regulations governing the use of the 108 Greenbelt; and,

NOW THEREFORE the Board of the Cariboo Regional District in open meeting assembled enacts as follows:

1. TITLE

A. This Bylaw shall be cited for all purposes as the “Cariboo Regional District 108 Greenbelt Community Use Property Control Bylaw No. 3670, 2001”.

2. AFFECTED LANDS

A. In the bylaw “Greenbelt Lands” means the land known as the 108 Greenbelt owned by the Cariboo Regional District and shown outlined on Schedule A attached to and forming part of this bylaw.

3. ENACTMENT

A. On Greenbelt Lands no person shall:

1. discharge firearms unless specifically permitted to do so under the Livestock Protection Act or for the purpose of destroying dangerous animals as permitted under the Wildlife Act;

2. cut or remove trees, logs, brushes or other natural growth without first obtaining the written consent of the Cariboo Regional District;

3. use a pesticide; except while in accordance with the Pesticide Control Act, and with the written permission of the Cariboo Regional District;

4. remove, damage or destroy any fence, gate, sign, or other structure or construct, erect or place any fence, gate, sign or other structure without first obtaining the written consent of the Cariboo Regional District;

5. camp overnight between the hours of 10:00 p.m. and 6:00 a.m. the following morning;

6. use any public beaches between the hours of 10:00 p.m. and 6:00 a.m. the following morning;

7. operate a motor vehicle without the express written permission of the Cariboo Regional District Board, with the exception of:

i. police, fire, ambulance, or other emergency vehicles;
ii. service vehicles as required for use on the Greenbelt Land
by the Cariboo Regional District, the Province of British Columbia, or a public utility;
iii. snowmobiles.

8. operate an aircraft or, being the owner of an aircraft, cause it to be operated on Greenbelt Land to gain access to the adjoining airport, or for any other reason.

4. CONTRAVENTION AND ENFORCEMENT

A) Except as otherwise provided in this bylaw, any person who violates any of the provisions of the bylaw or who suffers or permits any act or thing to be done in contravention of this bylaw or who refuses, or omits or neglects to fulfill, observe, carry out or perform any duty or obligation imposed by this bylaw commits an offence and is punishable in accordance with the Offence Act.

5. SEVERANCE

A) If any portion of this bylaw is for any reason held to be invalid by the decision of any court of competent jurisdiction, that portion may be severed from the bylaw and such decision shall not affect the validity of the remaining portions of this bylaw.

6. REPEAL

A) Bylaw No. 3082, cited as the “108 Greenbelt Community Use Property Control Bylaw No. 3082, 1995”, is hereby repealed.
